1 · Account eligibility

• You must be 18 years or older to create an account.
• You must provide an accurate, working email address.
• One person per account. You don't need an account to write a preview or to buy a single story; the 3-story family pack requires one.

2 · Pricing (one-time, not a subscription)

• Free: write a story or letter and read its opening, with its AI illustration. No payment and no account required.
• Keep the whole story — $9 one-time, per story: the complete story, a print-ready keepsake PDF, edits and up to 25 AI rewrites of that story (fair use), and a private link to share it.
• Family pack — $19 one-time: keep 3 whole stories. Requires a free account; unused stories don't expire.
• No subscriptions and no auto-renewal. You pay once for each story you choose to keep.
• 14-day money-back guarantee, no questions asked.
• All prices are in US dollars.

3 · Content acceptance policy

Acceptable content

• Personal memories, notes, and stories you type in
• The names and relationships of the people you write about (parent, grandparent, sibling, etc.)

Refused content (we will remove it and may terminate the account)

• Medical records or health data (HIPAA territory)
• Banking or financial documents (GLBA territory)
• Government identification (passport, SSN, driver's license scans)
• Notarized or legally-binding documents
• Wills, trusts, or estate planning documents
• Cryptocurrency keys or wallet data
• CSAM (illegal everywhere)
• Content meant to harass, defame, or expose a real person, or private details about someone they wouldn't want shared
• Hate speech, harassment, or threats

4 · Intellectual property

• You retain all ownership of the memories you share, and the stories and letters Fablely writes from them are yours.
• You grant Fablely a limited license to store, process, and display your content to provide the service — including writing your story and its illustration with AI providers, making your keepsake PDF, and showing a story to the people you share its private link with.
• We do not claim ownership. We do not sublicense your content. We do not train AI on your content.
• Fablely's brand, design, code, and AI prompts remain our intellectual property.

5 · Acceptable use

• Personal and family use only.
• No commercial reselling of Fablely-generated content without a separate agreement.
• No API abuse, scraping, or unauthorized automation.
• No attempts to access other users' data.
• No bypassing payment, rate limits, or security controls.

6 · Privacy reference

See /privacy for the full Privacy Policy. Key commitments:

• AES-256 encryption at rest
• No data sale, ever
• Download your data any time from Settings (your stories as text, account data as JSON)

7 · Cancellation and refunds

• Every purchase is one-time — there is no subscription to cancel and no auto-renewal.
• 14-day money-back guarantee, no questions asked: email us within 14 days of buying. A refunded story goes back to its free preview, and a refunded family pack's unused stories are removed from your account.
• Email hello@fablely.ai for any refund or help — we usually reply within a day or two.

8 · 30-day wind-down clause (NOT insurance)

If Fablely ceases operations under our control, we commit to:

• (a) 30 days of advance notice via the email on file
• (b) Continued read-only access to your archive during the wind-down period
• (c) A download of your data in ordinary formats (your stories as text, account data as JSON), and the keepsake PDF of every story you kept

No financial guarantee. In the event of involuntary cessation (bankruptcy, founder incapacitation, regulatory action), the commitments above may become impossible to fulfill. This is why we encourage you to download the keepsake PDF of every story you care about — it's a copy that works without Fablely and survives any outcome.

9 · One-time purchases

Fablely story unlocks and family packs are one-time consumer purchases of a digital service. They are:

• NOT a subscription (no recurring charges, no auto-renewal)
• NOT a security, equity, revenue share, or investment
• NOT covered by SIPC, FDIC, or any consumer-protection insurance

You pay once for each story you choose to keep ($9), or once for a family pack that keeps 3 stories ($19).

10 · Disclaimers

• We make no warranty of fitness, merchantability, or non-infringement beyond what is required by law.
• The service is provided "as is," except for the explicit commitments in these Terms.
• We are not a financial advisor, legal advisor, medical advisor, or tax advisor.
• We do not provide estate planning — see your attorney.
• We do not provide medical record management — see your doctor.
• We do not provide banking — see your bank.

11 · Limitation of liability

• Liability is capped at amounts you paid Fablely in the prior 12 months (standard SaaS clause).
• No liability for consequential, incidental, special, or punitive damages.
• Some non-waivable rights may apply under your state law; nothing here overrides those.

12 · Governing law

• Wyoming, USA (the LLC's formation state) governs these Terms.
• US users: disputes can go to small claims court in your state, or arbitration in Wyoming for larger claims.
• Canadian users: Wyoming law applies; small claims rights are preserved.

13 · Changes to these terms

• We provide 30-day email notice for material changes.
• Continued use of the service after the notice period counts as acceptance.

14 · Heir designation (operational, not legal)

• The Settings page lets you name one trusted heir. If your account is inactive for 24 months, we email you first; if you don't reply within 90 days, we email your heir a link to read-only access to your saved stories. They can read the stories you kept; they can't edit them, write new ones, or change the account, and ownership of the data does not transfer.
• This is an operational continuity feature, not a testamentary instrument. It does not create a will, trust, power of attorney, or any legally enforceable transfer of property or rights. For estate planning, consult a licensed attorney.
• For now the inactivity check is handled by hand: if you need it, or you are the heir, email hello@fablely.ai.

15 · Severability

If any provision of these Terms is found by a court of competent jurisdiction to be unlawful, void, or unenforceable, that provision is severable from these Terms and the remaining provisions continue in full force and effect.

16 · Entire agreement

These Terms, together with our Privacy Policy and any specific terms presented at the point of purchase (e.g., the Stripe checkout page), constitute the entire agreement between you and Northbright Labs LLC concerning the Fablely service. They supersede any prior agreements, communications, or representations.

17 · No waiver

Our failure or delay in enforcing any right or provision of these Terms does not waive that right or provision. A waiver of any provision is effective only if in writing and signed by us.

18 · Force majeure

Fablely is not liable for any failure or delay in performance caused by events outside our reasonable control, including (without limitation) acts of God, natural disasters, internet or infrastructure outages, third-party provider failures (Vercel, Supabase, Resend, Cloudflare, fal.ai, OpenRouter, Anthropic, Stripe), cyberattacks, governmental action, war, terrorism, or pandemic-related disruptions. We will use reasonable efforts to notify you and restore service.

19 · Assignment

You may not assign or transfer these Terms or your Fablely account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law, subject to the 30-day wind-down notice obligation in Section 8.
